LAW ON LAND TRAFFIC

(Amend)

Chapter I

General Provisions

 
 
 

Article 1 (Amend) Purpose

The Law on Land Traffic has purpose to define principles, regulations and measures on the

establishment, activities and management of land traffic to facilitate and control the circulation of human beings and the use of various vehicles on the roads, and land communication and transport, in order to ensure convenience, safety and order, to contribute to the protection and maintenance of the roads, the environment, life, assets and public of the Lao People ' s Democratic Republic and for international integration.

 

Article 2 (New) Land Traffic

Land Traffic refer to the circulation of human and animal beings use or not use for transport and the use of various vehicles on roads with comply under the regulation of land traffic.

 

Article 3 (Amend) Definitions

Terms specify herein means:

1. Traffic regulation means the detailed regulations that are related to land traffic;

2. Traffic   signs   means   the   signposts   directing   the   implementation   of   land   traffic regulations;

3. Traffic  marks  means  marks  installed,  marked,  written  or  drawn  on  roads,  road shoulders, or road signs, or that are erected over roads to signal or facilitate land traffic;

4. Driving  License  means  permit  license  issued  by  the  Ministry  of  Public  Works  and Transport;

5. Land User means drivers or use of various vehicles, pedestrian, animal controller, Road

keeper, refection, marked installed and signpost through land;

6. Way means extent area that aim to provide to the land traffic;

7. Road means area of street or way for the purpose of land traffic in city;

8. Face Way means way for the use of various vehicles on the roads;

9. Lane means way which divided extent face way pursuant to the length of way and has a standard wide as required;

10. Intersection means intersect way or cross in the same face way up to two way;

11. Crossroad means ways which divided into many ways;

12. Car Stop means stop use of vehicles at the specific point along the way or road in a short period without shutdown such vehicles and drivers are required to stay at the driver position;

13. Car Park means stop use of vehicles at the specific point along the way or road in a short period with shutdown such vehicles and drivers are entitled to move out of the vehicles;

14. Truck Tractor means Vehicles that powered by engine system and use for trailer;

15. Trailer means transport for stick with truck tractor;

16. Drag means transport for stick with general truck;

17. Special Travel means travel by procession of leader vehicles, state guest, ambulance car, fire truck, wrecker, national defense arm force  national security arm force car which has alarm system and undertaking emergency cases;

 

Article 4 (Amend) State Policy in respect of Land Traffic Work

The State has promotes individual, juristic person, through appropriate policies, all economic sectors within the country and overseas to contribute in the development, building  up, maintenance, installation and protection of the land traffic system with use modern science, technical and technology.

The State has supports and promotes a development of public transportation to respect any convenience traffic in city, open, safety and implement to the law and shall not effect to environment and fit to live in simultaneously.

Article 5 (Amend) Principle of Land Traffic Work

The Land Traffic Work is required to proceed as following:

1. Warranty that conform to the national economicsocial development plan, strategic plan and traffic safety plan in order to implement with regulation and modern;

2. Warranty that shall tidy, safety, convenience, open, continuously, successful with responsibility and included individual and general participates;

3. Warranty that shall integrity throughout the country and allocate of protection between the central and local;

4. Warranty that shall obtain a standard technical and safety in order to protect and use vehicles for individual, juristic person or organizations;

5. Warranty that comply under this law with region and international according to treaty and national treaty that Lao PDR is a member;

Article 6 (Amend) Obligations of Commuters

Lao citizens, aliens, apatrids, and foreign individuals who are commuting on the roads within the territory of the Lao PDR have obligations to respect and strictly implement of this law and land traffic regulations, and also oblige to protect, maintain, and provide convenience on the land traffic roads.

Article 7 (New) Scope of Law

This Law is under scope for individuals, juristic persons and organizations for both domestic and international included protection of traffic, construction of infrastructure and facility, operation of traffic in Lao PDR.

Article 8 (New) International Cooperations

The State has promotes and open, coordinate with foreign country, region and international

in respect of traffic in terms of deliberate case study, information, science and technology, install, maintenance, elevation, donation, investment, comply with treaty and national treaty that Lao PDR is member.

 

 

Chapter II

Land Traffic Regulations

Category 1

Land Traffic Regulations

Article 9 (Amend) General Regulations

Road traffic in the Lao PDR is on the right hand side, commuters is required to follow the lanes as specific defined and strictly comply with this law and traffic regulations.

Road traffic regulations shall be incorporated into the teaching and learning materials in different schools, as appropriate.

Article 10 (New) Pedestrian Regulations

  • Walking on the way and cross the way in city, municipality is required to proceed as following:

Walk on the way as specified for pedestrian, it required to walk on the left hand side if there is no specific way for pedestrian to be able to watch vehicles, it required to walk in a row and keep way if  there is several people except procession  of parade, procession  of state vehicles, procession of religious, procession of funeral or any other permits procession;

  • Walk on crosswalk, traffic signal, overpass, tunnel or specified places, it is required to walk on safety way if the above referenced is not available.

All is required to assist children, old people, disabled and person who is not possible to support himself when they cross the way.

Article 11 (Amend) Animals Regulations

It is prohibited to graze and release animals on the roads. When animals are moved along

the roads, there should be an animal herder and shall comply with traffic regulations.

The owners or the herders of such animal shall be liable for the damage caused by the animal when accident occurred caused by animals as specified in the law on contract commitment and

In case that area has regularly grazed or move animals through the way, it is required to arrange the caution sign to aware such animals. drivers shall be liable for the damage occur when accident occurred in the caution sign area.

 

Article 12 (New) Driver Regulations

Drivers for all vehicles shall be responsible and proceed as follow:

  • Have necessary documents i.e. vehicles driving licenses, carte grise, inspection certificates, entrance fee certificates, insurance certificates; in case that van carry on goods and bus are required more relevant supporting documents;
  • Inspection of vehicles technical standard based on regularly basis to keep safety and avoid any unexpected issues during travel;
  • Participates and provide convenience on inspection of land traffic control officers;
  • Assist wounded people and land traffic polices when accident occurred;
  • Stop and give the way to special travel;
  • Provide an exclusive right to the people who cross the way;
  • Removing vehicles out of way immediately when vehicles are broken down on the way.

 

 

 

Category 2

Vehicle Operators

 

Article 13 (New) Driving Licences Regulations

Examination to obtain driving licenses shall have the conditions as follow:

  • Completed curriculum of driving schools;
  • Obtain health certificate;
  • Age as specified under article 14 of this law.

Examinations  to  obtain,  and  issuance  of,  vehicles  driving  licences  shall  be  in  strict compliance with the regulations issued by the Ministry of Public Works and Transport.

Terms of examinations to obtain vehicles driving licenses for disable persons and infirmity are defined in specific regulation.

Article 14 (Amend) Age of Vehicle Operators

Age and qualify of each vehicle operators to obtain examination for driving licenses are as

follow:

  • Motorcycles less than 125 cc shall be at least 15 years of age;
  • Motorcycles more than 125 cc, tricycles, twowheeled hand tractors, twowheeled trailer

pulling tractors, personal transport vehicles, specific transport vehicles less than more than 9 seats inclusive of the driver seat or total weight less than 3,500 kg, public transport vehicles less than 9 seats inclusive of the driver seat shall be at least 18 years of age;

  • Transport goods vehicles, goods total weight from 3,500 kg to 7,000 kg, public transport vehicles less than 15 seats inclusive of the driver seat, trailer truck shall be at least 21 years of age;
  • Transport goods vehicles, goods total weight less than 15,000 kg, trailer, truck total weight less than 750 kg, public transport vehicles less than 35 seats shall be at least 25 years of age;
  • Transport goods vehicles total weight more than 15,000 kg, trailer, truck total weight more than 750 kg and public transport more than 36 seats shall be at least 28 years of age.

Article 15 (New) Driving Licenses

Driving licenses  issued by  Lao  PDR included  domestic  driving licenses  and  international driving licenses

Domestic licenses issued for Lao citizens, alien, nationalityless, foreign who passed vehicles driving examination in Lao PDR and in countries that are recognition of driving licences to which the Lao PDR, the term of a driving licence is five years, and may be extended another five years after the term expires.

International  licenses  issued  for  Lao  citizens,  alien,  nationalityless,  foreign  who  already obtained domestic driving licences for use outside countries.

Size, type and standard of driving are defined in specific regulations.

Article 16 (Amend) Vehicles Driving Licenses Types

Domestic Vehicles Driving Licenses shall arrange an alphabetically as follow:

  • A   : Motorcycles less than 125 cc;
  • A1 : Motorcycles more than 125 cc;
  • A2 : Personal motor tricycles and motorcycles, transport tricycles;
  • A3 : Twowheeled hand tractors, twowheeled trailerpulling tractors;
  • B: Vehicles total weight less than 3,500 kg, not more than 9 seats inclusive of the driver

seat;

  • C: Transport goods vehicles total weight from 3,500 kg to 7,500 kg;
  • C1: Transport goods vehicles total weight more than 7,500 kg to 15,000 kg;
  • C2: Transport goods vehicles total weight more than 15,000 kg;
  • D: Fourwheeled transport vehicles onward, less than 15 seats;
  • D1: Transport vehicles from 16 to 35 seats;
  • D2: Transport from 36 seats onward;
  • E: Vehicles (B), transport goods vehicles (C) and transport vehicles (D) for trailer total weight less than 750 kg;
  • E1: Transport goods (C2) for trailer more than 750 kg;

 

Article 17 (Amend) Foreign Driving Licenses

Foreign driving licenses are driving licenses issued by other countries.

Lao PDR acknowledge that foreign drivers who obtained international driving licenses or licenses issued by other countries that are parties to international conventions or agreements on mutual recognition of driving licences.

Article 18 (Amend) Driving and Loading Regulations

Driving and Loading for transport people and passengers shall comply as follow:

  • Not more than two persons shall be allowed to ride on a bicycle;
  • For motor bicycles, only one adult person and one child under eleven years of age are allowed to sit at the back; drivers and persons ride on a pillion shall use qualify helmet;
  • Only three persons are allowed on tricycles and motor cycles, inclusive of the operator;
  • Only five persons are allowed on Mechanised threewheeled or loaded goods less than 300 kg; for motortricycle, sky lab, only nine persons are allowed to sit or load goods less than 550 kg;
  • For Car, jeep, van, pickup shall load as standard of factory.

Drivers inclusive of persons who riding at the front shall use safety belt for fourwheeled types, children who are not able to use such safety belt shall riding at specified seats.

Article 19 (Amend) Speed Limits and clearance of vehicles Each various vehicles have the following speed limits:

  • For travel on traffic jam in city, municipality, community are not allowed than 40 km/h;
  • All cars and vehicles more than 125 cc are not allowed than 90 km/h for travel on land public road zone,;
  • Transport goods vehicles, transport vehicles and motorcycles less than 125 cc are not allowed than 70 km/h for travel on land public road zone,;

In addition, the maximum speed limits for each route shall comply as specified in limit speed  signs.

When two vehicles are traveling on the same lane, vehicles riding at the back shall maintain  an appropriate distance and apply with rumble strip, climate, vehicles sizes and loading vehicles to

ensure that safety if vehicles riding at the front will brake immediately. Vehicles Procession more than two shall maintain distance between each procession at least 150 m and another vehicle at least 25 m.

The  above  referenced  speed limits  are  exclusive  of  special  travel  vehicles  and  vehicles working on emergency cases such as accidents, injured, fire, flood and other emergency.

Article 20 (New) Alcohol limits for drivers

All drivers has the following limit for alcoholicity:

1. For drivers of all personal fourwheeled types

  • In breath:   0, 24 mg/l (BrAC);
  • In blood: 50 mg/ 100 ml  (BAC);
  • In urinate:  66, 5 mg/ 100 ml (Urine).

2. For divers of all nonregular route public carrier types

  • In breath:   0 mg/l (BrAC);
  • In blood: 0 mg/ 100 ml (BAC);
  • In urinate:  0 mg/ 100 ml (Urine).

3. For drivers of motorcycles and motor tricycles

  • In breath:   0, 14 mg/l (BrAC);
  • In blood: 30 mg/ 100 ml  (BAC);
  • In urinate:  39, 9 mg/ 100 ml(Urine).

The Control Land Traffic Officers shall have the rights to inspection of alcohol on breath test with drivers.

The Doctors shall inspection of alcoholicity and urinate with drivers and other party when accident occurred caused injured, death, loss of assets for a purpose of further legal proceeding.

 

Category 3

Land Traffic Signal Regulations

 

Article 21 (New) Land Traffic Signal Regulations

Land Traffic Signal Regulations has the following types:

  • Land Traffic signs;
  • Land Traffic signals;
  • Land Traffic marks.

The land traffic signal regulations shall nationwide valid. Drivers shall strictly comply with the land traffic regulations.

Article 22 (New) Land Traffic Signs

The Land Traffic Signs is a guide to comply with land traffic regulations and divided into the following categories:

  • Warning signs;
  • Prohibit signs;
  • Specification signs;
  • Right signs;
  • Guide signs;
  • Services signs;
  • Add signs;

Meaning and forms of each sign are specified in the land traffic regulations.

Article 23 (New) Land Traffic Signals

The Land Traffic Signals is a guide to comply with land traffic transport and sets in a form of

lights, colours, voices, people and model.

The Land Light Signals has the following colours:

  • Red light is for prohibit travel;
  • Yellow light is for awareness, stop;
  • Green light is for allow travel.

Article 24 (New) Land Traffic Marks

Land Traffic Marks shall inclusive of instalment marks, marks, writes, posts on front way, sideway, kerb, direction, cornerstone, safety fence, arrow way, lane, crosswalk and others for a purpose of notice and provide convenience on the land traffic.

Article 25 (New) Instalments of Land Traffic Signals

Signs, land traffic signs, land traffic signals shall qualify and correctly instalment as specified on  vehicles  technical  standard  and  comply  with  regulations  by  Ministry  of  Public  Works  and Transports. Provide  that  land  traffic signals  by  using  persons, shall  comply  with  regulations  by Ministry of Defense.

The Public Works and Transport Officers shall have the permanent rights to instalment, protect the traffic signal system.

The Land Traffic Polices or public road polices shall have temporary rights and protect the traffic signal system.

 

Category 4

Land Traffic Control

 

Article 26 (Amend) Land Traffic Control Officers+

The Land Traffic Control Officers has the following persons:

1. Land Traffic Polices shall responsible for provide convenience, control and inspection of traffic in city;

2. Public Road Polices shall responsible for provide convenience, control and inspection of traffic in suburb way;

3. Public Works and Transport Officers shall responsible for inspection of vehicles technical standard, all transport vehicles, public transport businesses and infrastructure for transport;

4. Authorised person from the state.

Land Traffic Control Officer shall have uniform and mark. The state shall contribution of vehicles and necessary equipment to the said Land Traffic Control Officer.

 

Article 27 (Amend) Functions of the Land Traffic Control Officers

The Land Traffic Control officers shall use uniforms, post mark, label when undertaking duties and strictly comply with any regulations specified by the Ministry of Defence, Ministry of Public Works and Transport. For each inspection, at least 3 officers are required.

The Land Traffic Control Officers shall solve the issues immediately when accident occurred, barrier, traffic jam or special travel.

The Land Traffic Control Officer shall have the special rights than traffic signal system.

 

Article 28 (Amend) Rights and Duties of Public Road Police and Traffic Police

Public Road Police and Traffic Police shall have the rights and duties as follow:

1. To provide convenience, control, inspection of compliance with this law and relevant laws;

2. Inspection of drivers, driving license, vehicles documents, alcohol test and  over speed limits; law;

3. Training, request for a fine or further legal proceedings when commits and violating of this

4. Detaining vehicles and drivers when accident occur caused death, seriously injured  or escape for further legal proceedings;

5. Detaining vehicles that not obtained any insurance when accident occurred caused injured and parties are fails to negotiate;

6. Lock vehicles when parking at the wrong place and obstruct the land traffic;

7. Inspection of black smoke, white smoke, noise of vehicles;

8. Maintenance vehicles and materials in a good conditions when detains vehicles;

9. Recording information, follow up persons who violating of this laws and propose to the officers;

10. Inspections, record of event, take a photo and mark the place where accident occurred, clear, provided full information together with examine accessories parties and  witness in  such events;

11. Complying with rights and duties under laws.

Public Road Police shall have the rights and duties to cooperate with the officer of Public Works and Transport for inspection of land transport on public road.

 

Article 29 (Amend) Rights and Duties of the Public Works and Transport Officers  The Public Works and Transport Officers has the following rights and duties:

1. To provide convenience, control and inspection of land transport businesses operations,

investigation of vehicles technical, loading of all vehicles, drivers, officers of transport goods and passengers;

2. To coordinate with the land traffic polices, public road polices for convenience, control and tidy for transport on the way;

3. To inspect of facilities, encumbrance of traffic and way based on ordinary basis to rectify.

Article 30 (New) Authorised Persons from the State

The Authorised Persons from the State are inclusive of persons or volunteer that the State has assigned for a purpose of support, control and facilitate the land traffic from time to time.

Rights and Duties of the authorised persons are described in specified regulations.

Article 31 (Amend) Inspection and Handling of Accidents+

When an accident happens in a certain location, the traffic police or public road police shall undertake an inspection of such accident immediately, recording, taking a photo and mark with clean, clear, full details of the place accident occurred together with inspection of relevant persons and witness in that event to solve the problem under laws and also removing such vehicles out of way and any encumbrance from the paths of land traffic.

 

 

Category 5

Road Construction and Road Maintenances

Article 32 (New) Road Construction Projects

All Road Construction Projects shall pass the following traffic safety procedures:

  • Possibilities study of the projects;
  • Preliminary drawings;
  • Construction drawings;
  • Constructions Periods;
  • Commencement Period;
  • Operation Period.

Each procedure is described in a specific regulation.

 

Article 33 (New) Road Construction and Road Maintenances

Road Construction and Road Maintenances shall warranty the reducing of environment and social impact as follow:

  • Convenience land traffic, clear and tidy;
  • Safety by instalment of signal posts, glitter caution mark, instalment of traffic lights at dark

time;

  • Assist in disabled, infirmity and persons who not able to support himself;
  • Construction or maintenance shall successful, expeditious and high qualify.

Technical Standard and Vehicles Protection

Category 1

Vehicles Technical Standard

Article 34 (Amend) Vehicles Type

Vehicles used in Lao PDR are divided into two types namely engine type and without engine type.

Engine type included motorcycles, motor tricycles, fourwheeled vehicles upward together with all types of engine vehicles.

Without engine type included bicycles, tricycles, carts, wheeled and so on that drag, push by persons or animals.

Article 35 (Amend) Vehicles Technical Standard

All types of vehicles imported, produced, assemble to be registered and used permanently in the Lao PDR shall comply with the technical standards of production factories, qualify as pecified by the Ministry of Public Works and Transports, and follow with treaty and international treaty that Lao PDR is a member.

For all types of vehicles from fourwheeled onward shall have the steering wheels on the left hand side except transport vehicles that operate cross border transport business as specified in article 15 of the Land Traffic Law.

Article 36 (Amend) Inspection of Vehicles Technical Standard

All types of vehicles shall strictly passed the inspection of technical standard and obtain certificate with the Inspection Center as certify by the Ministry of Public Works and Transport.

Article 37 (Amend) Repair of Vehicles

It shall not obstruct the traffic, environment, safety and correctly the technical standard when repairing of vehicles as specified by the Ministry of Public Works and Transports.

Establishment of repair shop and garages are specified in regulations.

 

Category 2

Vehicles Protection

 

Article 38 (New) General Regulations

Drivers for all types of vehicles shall strictly comply with the land traffic regulations, post the license plate, having relevant documents and obtained insurances as stipulated in article 42 of this law. For Twowheeled hand tractors, twowheeled trailerpulling tractors shall have brake, front light, back light and post glint sticker at the side and back.

Drivers for all types of vehicles without engines shall strictly comply with the land traffic regulation. For bicycle, tricycle shall have brake, front light, back light and post glint sticker at the side and back.

Article 39 (Amend) Registration of Civilian Vehicles

All types of civilians vehicles, including trailer trucks, trucks and heavy machineries such as: bulldozers, excavators, motor graders, compactors, and other heavy machineries, shall register and have licence plates in accordance with the regulations issued by the Ministry of Public Works and Transport.

Vehicles that sold from the shop shall post the license plate for facilitate the inspection of relevant officers and the seller shall responsible for registration of vehicles to the customers.

Article 40 (Amend) Registration of Vehicles of National Defence and Security Forces

Vehicles that are directly used for the activities of the National Defence and Security Forces shall be registered with, and have license plates of, the Ministry of National Defence or the Ministry of Interior.

Vehicles of persons which belong to the National Defence and Security Forces shall be  registered with, and have license plates of, the Ministry of Public Works and Transport.

Article 41 (Amend) Removal of Heavy Vehicles

The removal of heavy vehicles on public road shall be done by flatbed tow trucks or other transport trucks that meet technical standards; it shall post a mark if some parts were beetle from such vehicles, caution mark under regulations and shall get approval as stipulated in article 39 of the land traffic law.

Article 42 (New) Vehicles Insurances

All vehicles shall obtain insurances as specified under Insurance Law.

 

Chapter IV

Land Traffic Businesses

Article 43 (New) Land Traffic Business Types

Land Traffic Business Types are provided as follow:

1. Technical Inspection of Vehicles;

2. Vehicles Driver Education;

3. Production, instalment, Post Maintenances, Signals, Traffic Marks;

4. Vehicles Repair Services;

5. Car Park Services;

6. Tow Vehicles Services.

Article 44 (New) Establishment of Enterprises in respect of Land Traffic Businesses

Individuals, juristic person or organizations for both domestic and outside country who aim to establishment of enterprises in respect of land traffic business will obtain an approval for operate such businesses as specified under the Enterprises Law and Investment Promotion Law included the following conditions:

  • Economic Technical Assessment;
  • Having technocrats who gain experience for facilitate businesses operations;
  • Having technocrats who gain knowledge, capacity and specific experience in respect of land traffic as appropriate;
  • Having capital, vehicles machineries and materials as appropriate;
  • Having Registered Office Certificate;
  • Having Bank Statement Certificate;
  • Having ethics profession in respect of land traffic.

Public Works and Transport Department shall investigate the above referenced conditions and consider their opinion prior the registration of enterprises.

 

 

Chapter V

Association and Foundation in respect of Land Traffic

 

Category 1

Support Safety on Road Association

 

Article 45 (New) Registered Address of the Support Safety on Road Association

Pursuant to the laws, the Support Safety on Road Association is one of social organization under the Ministry of Public Works and Transport for a purpose of coordination center on land traffic matters and all social parts in order to develop the land traffic.

Article 46 (New) Intendancy of Association

The Support Safety on Road Associations has an intendancy for contribute the unity, intelligence of technocrats, facilitate of the land traffic and all segments, movement under the constitution, laws, regulations and ethic profession in order to protect, promote and development of career parts included contributed of benefits to the social and development the country.

Article 47 (New) Rights and Duties of Association

The Associations has the following rights and duties:

1. Developing regulations, operation plans, advertisements, published policy, laws, development of national economic and social plan together with development of the land traffic;

2. Supporting, establishment, promote the member and amendment of responsibilities, profession in order to obtain any progressive and successful;

3. Protecting of rights, rightfully benefits for members based on policy and laws;

4. Requesting for using modern technical sciencetechnology in respect of the land traffic;

5. To exchange of case study, experience in respect of the land traffic in order to improve any knowledge and capacity of members;

6. To seek for funding from all segments included domestic and outside country to the land traffic;

7. Increasing of unity in association and technocrats and coordinate with other associations for both domestic and outside country as assigned.

8. To  summarize  and  report  the  performance  with  the  Ministry  of  Public  Works  and Transport and relevant departments based on regularly basis.

9. To exercise such other rights and performs such other duties as assigned by the laws.

 

Category 2

Foundation in respect of Land Traffic

Article 48 (New) Foundations

The Foundations in respect of Land Traffic is one of social organization without seeking profits, establishment and operations under laws and regulations to assist victims from road accident.

Article 49 (New) Rights and Duties of Foundations

The Foundation has the following rights and duties:

1. To assist and support victims from road accidents;

2. To attempt and obtain support in terms of technical, academic, capital, materials and vehicles from sociality included domestic and outside country;

3. To use appropriate vehicles, equipment, and technical subjects to undertake the works;

4. To coordinate with the relevant departments in respect of assist and support victims from road accident, exchange of case study, experience with foundation and related departments;

5. To  summarize  and  report  the  performance  with  the  Ministry  of  Public  Works  and Transport and relevant departments based on regularly basis.

 

Chapter VI

Prohibits

Article 50 (New) General Prohibits

Individuals, juristic person or organizations are prohibits the following acts:

1. Destroying  land  traffic  signal  such  as  signal  post,  mark,  traffic  light  included  made adulterated thing and conceal the traffic signal post;

2. Posting licenses plates not correctly under regulations;

3. Posting signs, advertisements, leave marks, sell goods, organize ceremony on the way, sideways and prohibit area without permission;

4. Playing sports on sideways and walkways;

5. Constructing, elaborate, building on the preserve way;

6. Operating businesses on curve, narrow parts or sideway may risks for accident occurs and dangerous park;

7. Excavating, cover with soil, piles soil, piles materials on the way and sideway;

8. Releasing dung, slush, sewage, oil, wash vehicles on the way and sideway;

9. Parking on walkway, crossroad, curve, narrow paths, entry  exit ways to the bridge and on the bridge;

10. Releasing children cross the way, play on sideway alone;

11. Raising, release animals on the way, move animals on the way without controller;

12. Violation land traffic regulations and relevant laws.

Article 51 (New) Prohibits for Drivers

Drivers are prohibits to do the following acts:

1. Driving vehicles when drunk;

2. Driving  vehicles  fast  and  over  speed  limit  specified,  convexity  to  the  left  and  right, careless, and violating of the laws;

3. Using cell phone, electronic devices when cross the way;

4. Using cell phone, watching TV or playing electronic devices when traveling on vehicles;

5. Operating on the wrong side of the road;

6. Driving motorcycles, all types of bicycles on endways and obstruct way;

7. Parking huge vehicles on the way and block the land traffic;

8. Raise an umbrella when travelling on motorcycles, bicycles;

9. Over loading of passengers, goods, and capacity;

10. Carry on hazards goods without permission;

11. Repair vehicles on the way, on the bridge;

12. Operating vehicles that emit noise above the standard;

13. Racing all vehicles without permission;

14. Lay log, lever, stones or any obstruction that trig vehicles on the way;

15. Violation land traffic regulations and relevant laws.

Article 52 (New) Prohibit for the land traffic operators businesses The land traffic operators shall prohibit as following:

1. To rent and assign enterprise registration certificate;

2. To sell, transfer the land traffic projects without permission of the owner;

3. To operate business incorrectly type as permission;

4. To conspire, employ, provide bribe for benefit of businesses;

5. Violation land traffic regulations and relevant laws.

Article 53 (New) Prohibit for the land traffic control officers and relevant officers

The land traffic control officers and relevant officers shall prohibit as following:

1. To operate businesses, consult or be technocrat officers with the land traffic enterprises;

2. To disclose auction information in respect of construction project, repair and instalments of the land traffic;

3. To conspire, requested, demand, received bribe, over limit for exercise power, counterfeit of documents, abuse of official functions for individual and group;

4. To neglect of duties, postpone documents in terms of the land traffic, remain inactive for incorrect act of operators;

5. To insult and bad behaviour, threaten the passer and drivers;

6. Violation land traffic regulations and relevant laws.

 

Chapter VII

Resolutions of the Difference

Article 54 (New) Resolutions of the difference types Resolutions of the difference has the following types:

Article 58 (New) Court Order

The Committee shall coordinate with domestic and international for protect the land traffic to obtain progress and expand into the national defense arm force  national security arm force.

Article 61 (New) Safety on Public Road Committee Systems

The Safety on public road committee systems has the following systems:

1. National committee for safety on public road;

2. District, SubDistrict Committee for safety on public road;

3. City, municipality Committee for safety on public road.

 

Article 62 (New) Structures of National Committee for Safety on Public Road

The national committee for safety on public road has the following structures:

1. Public works and Transport Minister as a Chairman;

2. Defense Deputy Minister as a ViceChairman;

3. Education and Sports Deputy Minister as a Committee;

4. Public Health Deputy Minister as a Committee;

5. Statement, Cultures and Travel Deputy Minster as a Committee;

6. Finance Deputy Minister as a Committee;

7. Chairman of Kadaeng Lao Organization as a Committee;

8. Vice  Chairman of Lao Trade Union Center as a Committee;

9. Vice  Chairman of Lao Women Union Center as a Committee;

12. Representative of the road traffic foundation as a Committee.

The National Safety on Public Road shall appoint by the Prime Minister and the secretary department residing at the Ministry of Public Works and Transports appointed by the Chairman of National Committee for Safety on Public Road.

Committee for safety on public road in each province, capital has the following structures:

1. Head of public works and transport department as a Chairman;

2. Vice  Chairman of the national defense arm force department as a Vice  Chairman;

3. Vice  Chairman of educations and sports department as a Committee;

4. Vice  Chairman of public health department as a Committee;

5. Vice  Chairman of statement, cultures and travel department as a committee;

6. Vice  Chairman of finance department as a committee;

7. Head of Provincial, Capital Kadaeng Office as a Committee;

8. Vice  Chairman of Provincial, Capital Lao Trade Union as a Committee;

9. Vice  Chairman of Provincial, Capital Lao Women Union as a Committee;

10. Deputy  secretary general Provincial, Capital Lao Uprising People as a Committee;

11. Representative of the relevant businesses sectors included the state sector and private sector as a Committee;

Article 65 (New) Rights and Duties of Safety on Public Road Committee

The Safety on public road committee shall have rights and duties as follow:

1. To establishment of internal regulations, investigation policy, strategic plan and  safety operation plan;

2. To establishment of policy, strategic plan and safety operation plan;

3. To  advice,  follow  up,  inspection,  constrain  from  and  coordinate  with  other  sectors, township and relevant sectors for safety on public road;

4. To seek for foundation, protection and facilitate fund from domestic and outside country into the safety on public road;

5. To Discuss and cooperation with outside country as assigned;

6. To summarize report of the land traffic performance with the superior;

7. To comply right and other duties as assigned and specified under laws.

 

Chapter IX

Protection and Inspection of Land Traffic

Category I

Protection of the Land Traffic

Article 66 (Amend) Protection of Land Traffic Organization

5. To coordinate with the Ministry of Defense, Ministry, other relevant organizations and Municipality for issue policy, strategic plan, operation plan regarding the land traffic;

6. To manage and inspect vehicle registrations to issue the correct licenses throughout the country;

7. To study and analyse road accident statistics and the volume of traffic throughout the country;

8. To issue regulations of vehicles and license plate, vehicle registrations, production and fix licenses plates included cooperation with the provincial governor and license plate auctions, training, examination and issue driving license throughout the country;

9. Improve, maintain and exaltation personnel skill on the land traffic;

10. To cooperate with international organisations and seek funding for the development of land traffic;

3. To advertise, circulate policy, strategic plan and laws in relation to the land traffic for obtain any conscious with people;

4. To coordinate with the Ministry of Public Works and Transport, other Ministry, other relevant organization and municipality for comply with policy, strategic plan, master plan in respect of the land traffic;

5. To Lead, follow, facilitate and control the land traffic on the way;

6. To inspect the vehicles information to for the production of licenses plates;

7. To protect vehicles registration, production responsible, fix and use licenses plates;

8. To protect safety and allocate the land traffic to be in order, ascertain road  accident statistics and the volume of traffic for protect plan and reduce the road accident;

9. To follow and evaluate the compliance under the land traffic law and relevant laws throughout the country;

2. To coordinate with the defense headquarter, other departments for train, advertise, circulate to obtain the civil social in respect of land traffic within province, capital;

3. To  ascertain  road  accident  statistics  and  the  volume  of  vehicles  and  traffic  within province, capital;

4. To protect vehicles registration, safety on land traffic and driving, driving school, driving center, driving examination, technical inspection, vehicle garages and other businesses related to land traffic;

5. To insert vehicles data for issuance of license;

6. To propose proposal for capital in domestic and outside country to development of land traffic within province, capital;

7. To protect, install the post and land traffic mark, follow, conservation of post, land traffic marks on the way to avoid any destruct;

8. To  arrange  examination,  issuance  of  driving  licenses,  vehicles  registration,  fixes  the vehicles license plates within province, capital;

2. To coordinate with the Public Works and Transport Department, other departments for train, advertise, circulate to obtain the civil social in each province, capital;

3. To strictly follow any respect and comply with the laws for drivers and vehicles on the land traffic road to protect safety and tidy of the land traffic;

4. To inspection of vehicles information prior production or fix the license plates;

5. To product and fix the license plates as assigned by the Ministry of defense;

6. To investigate, ascertain road accident statistics and the volume of vehicles and traffic within Province, Capital for reduce and intersection of accidents;

2. To coordinate with the Defense Headquarter, other offices for train, advertise, circulate to obtain the civil social in relation to land traffic in each capital, municipality;

3. To establishment, protection of vehicle registration, driving licenses examination for motorcycle, Twowheeled hand tractors, twowheeled trailerpulling tractors within capital, municipality;

4. To provide an opinion in relation to issuance of operation businesses licenses such as vehicles garages, rap and weld vehicles, weld wheeled, vehicles wash, factory, machine shop, material shop, modify shop and other businesses in relation to land traffic;

5. To protect, instalment of post and land traffic marks pursuant to responsibilities;

6. To participate for solve accident occur in capital, municipality according to the laws;

7. To protect vehicles garages, technical inspection for motorcycles, tractors

8. To ascertain road accident statistics and the volume of vehicles and traffic within capital,municipality;

Article 72 (Amend) Rights and Duties of Capital, Municipality Defense Headquarter:

In the management of land traffic, the Defense Headquarter in each capital, municipality has the following main rights and duties:

1. To establishment of the policy, strategic plans and master plan in respect of land traffic under responsibilities;

2. To coordinate with the Public Works and Transport Office, other offices for train, advertise, published for a purpose of obtain the civil social in relation to land traffic within capital, municipality;

3. To coordinate with the Public Works and Transport for protection of land traffic posts, land traffic marks on the land traffic way in each capital, municipality;

4. To tidy allocate on the land traffic way, public vehicles parks and facilitate any convenience, land traffic control for aerate, safety and convenience;

5. To investigate, examine, solve and brief road accident occur in each capital, municipality according to the laws;

6. To ascertain road accident statistics and the volume of vehicles and traffic within capital,municipality;

7. To summarize and report the land traffic performance with the Defense Headquarter Province, Capital, Capital Polity, and municipality based on regularly basis;

Article 73 (New) Rights and Duties of Villages Polity

In the management of land traffic, the Villages Polity has the following main rights and duties:

1. To circulate order, memorandum, instruction in relation to land traffic to the people in villages;

2. To excite people for protect the signal signs, signal lights, land traffic marks on the way together with report the damages of posts, traffic lights, land traffic marks to the Public Works and Transport Capital, Municipality immediately;

3. To participate, assist to control place of accident occurred and report to the traffic police, public police Capital, Municipality immediately;

4. To facilitate any convenience and participate with the land traffic control officer;

5. To exercise such other rights and performs such other duties as assigned by the laws.

 

 

Category 2

Inspection of Land Traffic

 

Article 74 (New) Inspection Organizations

Inspection Organizations shall divided into two types as follow:

1. Internal Inspection Organization shall mean the same organization as protection of land traffic organization as stipulated in article 66 of this law;

2. External Inspection Organization shall include:

  • National Assemble as specified under the law on inspection of National Assemble;
  • State Inspection and Anti _ Corruption Organization as defined under the law on Anti Corruption;
  • Investigation Organization as described under the law on State Investigation;
  • Lao National Building, Public Organizations, People, and Media.

External Inspection is aim to inspect, discharge of protection, and inspection land traffic organization for a purpose of quality, fair, reveal, and strong.

Article 75 (New) Rights and Duties of Inspection Organizations

The Inspection Organizations shall have the rights and duties as stipulated in articles 76 and 77 of this law.

Article 76 (New) Details of Inspection

Details of inspection for land traffic are provided as follow:

1. Establishment of the policy, strategic plans, master plan, laws in respect of land traffic;

2. Construct Projects, instalments, repairs and maintenances for land traffic signal system;

3. Comply land traffic safety measure, resolving of life impact, health, people assets, public assets and environment;

4. Business Operations for repairs, modify, vehicles technical inspection, training, test and driving licenses examinations;

5. Operators documents, documents and vehicles licenses plates, alcohol test and speed limit of all vehicles which assigned land traffic police and public road police to inspect such documents.

It is required to comply with any provisions for inspection as specified under other relevant laws.

Article 77 (New) Inspections Types

Inspection of Land Traffic shall divide into three types as follow:

1. Ordinary Inspection shall inspect as plan based on regularly basis and defined in a specific timeframe;

2. Advance Notice Inspection shall inspect as necessary needed by provided advance notice;

3. Unexpected Inspection shall inspect immediately without notice.

It is required to strictly comply with the laws for inspection of land traffic.

 

Chapter X

National Weeks for Safety on Land Traffic Uniforms and Marks

Article 78 (New) National Weeks for Safety on Land Traffic

The National weeks for safety on land traffic are defined as the first week of April.

For each year, Ministry of Public Works and Transports shall be a host and cooperate with the Ministry of Defense, other Ministry, other organizations and all local authorities for plan, ask for assistances, vehicles, materials support and capital with all social sectors for the broad operation of safety on land traffic in that week.

Article 79 (New) Uniforms and Marks

The Ministry of Defense shall define uniforms, marks for the land traffic police and public road police.

The Ministry of Public Works and Transports shall define uniforms, marks for the the Public Works and Transport officer

 

Chapter XI

Policies Towards Persons with Outstanding Achievement and Measures Against Violators

Article 80 Policies Towards Persons with Outstanding Achievement

Individuals, Juristic Persons or organisations that participate in the management of land traffic effectively and that ensure safety and orderliness, or preserve and protect cleanliness, the environment, the traffic signal system, or the property of the State and individuals along the roads will be rewarded and receive other policies, as appropriate, that will be determined in detail by the government.

Article 81 Measures Against Violators

Individuals, Juristic Person or organizations that violate any provision of this law and other relevant laws will be reeducated, fined, compensate damages or subject to laws sanctions, depending on the severity of the case.

Article 82 ReEducation Measures

Individuals, Juristic Person or organizations that commit a minor violation of any violation of this law and relevant laws and not subject to criminal sanctions, will be reeducated and cautions.

Article 83 Discipline measures

The Land Traffic Control Officer and relevant officers who violating of this law and relevant laws and not subject to criminal sanctions, less damages and not pay attention to report the offence, evasion of commit, shall subject to discipline sanctions such as warn, cancel of promote and dismiss.

Article 84 (Amend) Fines

Individuals, Juristic Person or organizations that violate any provision of this law and relevant laws and not subject to the criminal sanctions shall compensate for a fine in the following cases:

  • Driving vehicles when drunk and over limit specified;
  • Driving vehicles fast and over speed limit specified;
  • Not wearing standard helmets when travelling on motorcycles;
  • Raise an umbrella when travelling on motorcycles;
  • Using cell phone, watching TV or playing electronic devices when traveling on vehicles;
  • Disobeying traffic lights, signs, and marks;
  • Not having driving licence or the documents accompanies vehicles;
  • Operating on the wrong side of the road;
  • Operating vehicles that emit noise above the standard;
  • Turning on the high beam headlight in violation of regulations;
  • Not turning on lights in the evening;
  • Turning on the light(s) on only one side for fourwheeled vehicles on ward;
  • Not turning on lights during the daytime when the weather causes poor visibility, such as: heavy rain, thick fog, dusts;
  • Emission of smoke beyond the standard;
  • Having a vehicle without brakes, having no rear view mirror;
  • Causing dirt and obstacles on the roads;
  • Over loading, over size, over limit;
  • Modify vehicles technical without permission;
  • Violation land traffic regulations and relevant laws;

Fine rates are defined in accordance with specific regulations.

Article 85 (New) Commercial Measures

Any  individual,  Juristic  Person  or  Organizations  who  commits  and  offence  in  terms  of commercial and violating this laws shall subject to the compensate such damage occur.

Article 86 Criminal Measures

Any individual who commits an offence in terms of criminal and violating this law shall

subject to the criminal sanctions.

Article 87 (New) Supplementary Measures

In addition to the main measures provided for in article 86 of this law, offenders shall be liable to supplementary measures such as loss point of driving licenses or removal of licences under specific regulation.

 

Chapter XII

Final Provisions

 

Article 88 Implementation

The government of the Lao People ' s Democratic Republic is assigned to implement this law.

Article 89 Effectiveness

This law shall come into effect after sixty days from the date of the promulgating decree issued by the President of the Lao People's Democratic Republic.

This law shall supersede the previous land traffic law no. 02/NA, dated 08 April 2000. Provisions and regulations that contradict this law are null and void.

LAW ON LAND TRAFFIC

(Amend)

Chapter I

General Provisions

 
 
 

Article 1 (Amend) Purpose

The Law on Land Traffic has purpose to define principles, regulations and measures on the

establishment, activities and management of land traffic to facilitate and control the circulation of human beings and the use of various vehicles on the roads, and land communication and transport, in order to ensure convenience, safety and order, to contribute to the protection and maintenance of the roads, the environment, life, assets and public of the Lao People ' s Democratic Republic and for international integration.

 

Article 2 (New) Land Traffic

Land Traffic refer to the circulation of human and animal beings use or not use for transport and the use of various vehicles on roads with comply under the regulation of land traffic.

 

Article 3 (Amend) Definitions

Terms specify herein means:

1. Traffic regulation means the detailed regulations that are related to land traffic;

2. Traffic   signs   means   the   signposts   directing   the   implementation   of   land   traffic regulations;

3. Traffic  marks  means  marks  installed,  marked,  written  or  drawn  on  roads,  road shoulders, or road signs, or that are erected over roads to signal or facilitate land traffic;

4. Driving  License  means  permit  license  issued  by  the  Ministry  of  Public  Works  and Transport;

5. Land User means drivers or use of various vehicles, pedestrian, animal controller, Road

keeper, refection, marked installed and signpost through land;

6. Way means extent area that aim to provide to the land traffic;

7. Road means area of street or way for the purpose of land traffic in city;

8. Face Way means way for the use of various vehicles on the roads;

9. Lane means way which divided extent face way pursuant to the length of way and has a standard wide as required;

10. Intersection means intersect way or cross in the same face way up to two way;

11. Crossroad means ways which divided into many ways;

12. Car Stop means stop use of vehicles at the specific point along the way or road in a short period without shutdown such vehicles and drivers are required to stay at the driver position;

13. Car Park means stop use of vehicles at the specific point along the way or road in a short period with shutdown such vehicles and drivers are entitled to move out of the vehicles;

14. Truck Tractor means Vehicles that powered by engine system and use for trailer;

15. Trailer means transport for stick with truck tractor;

16. Drag means transport for stick with general truck;

17. Special Travel means travel by procession of leader vehicles, state guest, ambulance car, fire truck, wrecker, national defense arm force  national security arm force car which has alarm system and undertaking emergency cases;

 

Article 4 (Amend) State Policy in respect of Land Traffic Work

The State has promotes individual, juristic person, through appropriate policies, all economic sectors within the country and overseas to contribute in the development, building  up, maintenance, installation and protection of the land traffic system with use modern science, technical and technology.

The State has supports and promotes a development of public transportation to respect any convenience traffic in city, open, safety and implement to the law and shall not effect to environment and fit to live in simultaneously.

Article 5 (Amend) Principle of Land Traffic Work

The Land Traffic Work is required to proceed as following:

1. Warranty that conform to the national economicsocial development plan, strategic plan and traffic safety plan in order to implement with regulation and modern;

2. Warranty that shall tidy, safety, convenience, open, continuously, successful with responsibility and included individual and general participates;

3. Warranty that shall integrity throughout the country and allocate of protection between the central and local;

4. Warranty that shall obtain a standard technical and safety in order to protect and use vehicles for individual, juristic person or organizations;

5. Warranty that comply under this law with region and international according to treaty and national treaty that Lao PDR is a member;

Article 6 (Amend) Obligations of Commuters

Lao citizens, aliens, apatrids, and foreign individuals who are commuting on the roads within the territory of the Lao PDR have obligations to respect and strictly implement of this law and land traffic regulations, and also oblige to protect, maintain, and provide convenience on the land traffic roads.

Article 7 (New) Scope of Law

This Law is under scope for individuals, juristic persons and organizations for both domestic and international included protection of traffic, construction of infrastructure and facility, operation of traffic in Lao PDR.

Article 8 (New) International Cooperations

The State has promotes and open, coordinate with foreign country, region and international

in respect of traffic in terms of deliberate case study, information, science and technology, install, maintenance, elevation, donation, investment, comply with treaty and national treaty that Lao PDR is member.

 

 

Chapter II

Land Traffic Regulations

Category 1

Land Traffic Regulations

Article 9 (Amend) General Regulations

Road traffic in the Lao PDR is on the right hand side, commuters is required to follow the lanes as specific defined and strictly comply with this law and traffic regulations.

Road traffic regulations shall be incorporated into the teaching and learning materials in different schools, as appropriate.

Article 10 (New) Pedestrian Regulations

  • Walking on the way and cross the way in city, municipality is required to proceed as following:

Walk on the way as specified for pedestrian, it required to walk on the left hand side if there is no specific way for pedestrian to be able to watch vehicles, it required to walk in a row and keep way if  there is several people except procession  of parade, procession  of state vehicles, procession of religious, procession of funeral or any other permits procession;

  • Walk on crosswalk, traffic signal, overpass, tunnel or specified places, it is required to walk on safety way if the above referenced is not available.

All is required to assist children, old people, disabled and person who is not possible to support himself when they cross the way.

Article 11 (Amend) Animals Regulations

It is prohibited to graze and release animals on the roads. When animals are moved along

the roads, there should be an animal herder and shall comply with traffic regulations.

The owners or the herders of such animal shall be liable for the damage caused by the animal when accident occurred caused by animals as specified in the law on contract commitment and

In case that area has regularly grazed or move animals through the way, it is required to arrange the caution sign to aware such animals. drivers shall be liable for the damage occur when accident occurred in the caution sign area.

 

Article 12 (New) Driver Regulations

Drivers for all vehicles shall be responsible and proceed as follow:

  • Have necessary documents i.e. vehicles driving licenses, carte grise, inspection certificates, entrance fee certificates, insurance certificates; in case that van carry on goods and bus are required more relevant supporting documents;
  • Inspection of vehicles technical standard based on regularly basis to keep safety and avoid any unexpected issues during travel;
  • Participates and provide convenience on inspection of land traffic control officers;
  • Assist wounded people and land traffic polices when accident occurred;
  • Stop and give the way to special travel;
  • Provide an exclusive right to the people who cross the way;
  • Removing vehicles out of way immediately when vehicles are broken down on the way.

 

 

 

Category 2

Vehicle Operators

 

Article 13 (New) Driving Licences Regulations

Examination to obtain driving licenses shall have the conditions as follow:

  • Completed curriculum of driving schools;
  • Obtain health certificate;
  • Age as specified under article 14 of this law.

Examinations  to  obtain,  and  issuance  of,  vehicles  driving  licences  shall  be  in  strict compliance with the regulations issued by the Ministry of Public Works and Transport.

Terms of examinations to obtain vehicles driving licenses for disable persons and infirmity are defined in specific regulation.

Article 14 (Amend) Age of Vehicle Operators

Age and qualify of each vehicle operators to obtain examination for driving licenses are as

follow:

  • Motorcycles less than 125 cc shall be at least 15 years of age;
  • Motorcycles more than 125 cc, tricycles, twowheeled hand tractors, twowheeled trailer

pulling tractors, personal transport vehicles, specific transport vehicles less than more than 9 seats inclusive of the driver seat or total weight less than 3,500 kg, public transport vehicles less than 9 seats inclusive of the driver seat shall be at least 18 years of age;

  • Transport goods vehicles, goods total weight from 3,500 kg to 7,000 kg, public transport vehicles less than 15 seats inclusive of the driver seat, trailer truck shall be at least 21 years of age;
  • Transport goods vehicles, goods total weight less than 15,000 kg, trailer, truck total weight less than 750 kg, public transport vehicles less than 35 seats shall be at least 25 years of age;
  • Transport goods vehicles total weight more than 15,000 kg, trailer, truck total weight more than 750 kg and public transport more than 36 seats shall be at least 28 years of age.

Article 15 (New) Driving Licenses

Driving licenses  issued by  Lao  PDR included  domestic  driving licenses  and  international driving licenses

Domestic licenses issued for Lao citizens, alien, nationalityless, foreign who passed vehicles driving examination in Lao PDR and in countries that are recognition of driving licences to which the Lao PDR, the term of a driving licence is five years, and may be extended another five years after the term expires.

International  licenses  issued  for  Lao  citizens,  alien,  nationalityless,  foreign  who  already obtained domestic driving licences for use outside countries.

Size, type and standard of driving are defined in specific regulations.

Article 16 (Amend) Vehicles Driving Licenses Types

Domestic Vehicles Driving Licenses shall arrange an alphabetically as follow:

  • A   : Motorcycles less than 125 cc;
  • A1 : Motorcycles more than 125 cc;
  • A2 : Personal motor tricycles and motorcycles, transport tricycles;
  • A3 : Twowheeled hand tractors, twowheeled trailerpulling tractors;
  • B: Vehicles total weight less than 3,500 kg, not more than 9 seats inclusive of the driver

seat;

  • C: Transport goods vehicles total weight from 3,500 kg to 7,500 kg;
  • C1: Transport goods vehicles total weight more than 7,500 kg to 15,000 kg;
  • C2: Transport goods vehicles total weight more than 15,000 kg;
  • D: Fourwheeled transport vehicles onward, less than 15 seats;
  • D1: Transport vehicles from 16 to 35 seats;
  • D2: Transport from 36 seats onward;
  • E: Vehicles (B), transport goods vehicles (C) and transport vehicles (D) for trailer total weight less than 750 kg;
  • E1: Transport goods (C2) for trailer more than 750 kg;

 

Article 17 (Amend) Foreign Driving Licenses

Foreign driving licenses are driving licenses issued by other countries.

Lao PDR acknowledge that foreign drivers who obtained international driving licenses or licenses issued by other countries that are parties to international conventions or agreements on mutual recognition of driving licences.

Article 18 (Amend) Driving and Loading Regulations

Driving and Loading for transport people and passengers shall comply as follow:

  • Not more than two persons shall be allowed to ride on a bicycle;
  • For motor bicycles, only one adult person and one child under eleven years of age are allowed to sit at the back; drivers and persons ride on a pillion shall use qualify helmet;
  • Only three persons are allowed on tricycles and motor cycles, inclusive of the operator;
  • Only five persons are allowed on Mechanised threewheeled or loaded goods less than 300 kg; for motortricycle, sky lab, only nine persons are allowed to sit or load goods less than 550 kg;
  • For Car, jeep, van, pickup shall load as standard of factory.

Drivers inclusive of persons who riding at the front shall use safety belt for fourwheeled types, children who are not able to use such safety belt shall riding at specified seats.

Article 19 (Amend) Speed Limits and clearance of vehicles Each various vehicles have the following speed limits:

  • For travel on traffic jam in city, municipality, community are not allowed than 40 km/h;
  • All cars and vehicles more than 125 cc are not allowed than 90 km/h for travel on land public road zone,;
  • Transport goods vehicles, transport vehicles and motorcycles less than 125 cc are not allowed than 70 km/h for travel on land public road zone,;

In addition, the maximum speed limits for each route shall comply as specified in limit speed  signs.

When two vehicles are traveling on the same lane, vehicles riding at the back shall maintain  an appropriate distance and apply with rumble strip, climate, vehicles sizes and loading vehicles to

ensure that safety if vehicles riding at the front will brake immediately. Vehicles Procession more than two shall maintain distance between each procession at least 150 m and another vehicle at least 25 m.

The  above  referenced  speed limits  are  exclusive  of  special  travel  vehicles  and  vehicles working on emergency cases such as accidents, injured, fire, flood and other emergency.

Article 20 (New) Alcohol limits for drivers

All drivers has the following limit for alcoholicity:

1. For drivers of all personal fourwheeled types

  • In breath:   0, 24 mg/l (BrAC);
  • In blood: 50 mg/ 100 ml  (BAC);
  • In urinate:  66, 5 mg/ 100 ml (Urine).

2. For divers of all nonregular route public carrier types

  • In breath:   0 mg/l (BrAC);
  • In blood: 0 mg/ 100 ml (BAC);
  • In urinate:  0 mg/ 100 ml (Urine).

3. For drivers of motorcycles and motor tricycles

  • In breath:   0, 14 mg/l (BrAC);
  • In blood: 30 mg/ 100 ml  (BAC);
  • In urinate:  39, 9 mg/ 100 ml(Urine).

The Control Land Traffic Officers shall have the rights to inspection of alcohol on breath test with drivers.

The Doctors shall inspection of alcoholicity and urinate with drivers and other party when accident occurred caused injured, death, loss of assets for a purpose of further legal proceeding.

 

Category 3

Land Traffic Signal Regulations

 

Article 21 (New) Land Traffic Signal Regulations

Land Traffic Signal Regulations has the following types:

  • Land Traffic signs;
  • Land Traffic signals;
  • Land Traffic marks.

The land traffic signal regulations shall nationwide valid. Drivers shall strictly comply with the land traffic regulations.

Article 22 (New) Land Traffic Signs

The Land Traffic Signs is a guide to comply with land traffic regulations and divided into the following categories:

  • Warning signs;
  • Prohibit signs;
  • Specification signs;
  • Right signs;
  • Guide signs;
  • Services signs;
  • Add signs;

Meaning and forms of each sign are specified in the land traffic regulations.

Article 23 (New) Land Traffic Signals

The Land Traffic Signals is a guide to comply with land traffic transport and sets in a form of

lights, colours, voices, people and model.

The Land Light Signals has the following colours:

  • Red light is for prohibit travel;
  • Yellow light is for awareness, stop;
  • Green light is for allow travel.

Article 24 (New) Land Traffic Marks

Land Traffic Marks shall inclusive of instalment marks, marks, writes, posts on front way, sideway, kerb, direction, cornerstone, safety fence, arrow way, lane, crosswalk and others for a purpose of notice and provide convenience on the land traffic.

Article 25 (New) Instalments of Land Traffic Signals

Signs, land traffic signs, land traffic signals shall qualify and correctly instalment as specified on  vehicles  technical  standard  and  comply  with  regulations  by  Ministry  of  Public  Works  and Transports. Provide  that  land  traffic signals  by  using  persons, shall  comply  with  regulations  by Ministry of Defense.

The Public Works and Transport Officers shall have the permanent rights to instalment, protect the traffic signal system.

The Land Traffic Polices or public road polices shall have temporary rights and protect the traffic signal system.

 

Category 4

Land Traffic Control

 

Article 26 (Amend) Land Traffic Control Officers+

The Land Traffic Control Officers has the following persons:

1. Land Traffic Polices shall responsible for provide convenience, control and inspection of traffic in city;

2. Public Road Polices shall responsible for provide convenience, control and inspection of traffic in suburb way;

3. Public Works and Transport Officers shall responsible for inspection of vehicles technical standard, all transport vehicles, public transport businesses and infrastructure for transport;

4. Authorised person from the state.

Land Traffic Control Officer shall have uniform and mark. The state shall contribution of vehicles and necessary equipment to the said Land Traffic Control Officer.

 

Article 27 (Amend) Functions of the Land Traffic Control Officers

The Land Traffic Control officers shall use uniforms, post mark, label when undertaking duties and strictly comply with any regulations specified by the Ministry of Defence, Ministry of Public Works and Transport. For each inspection, at least 3 officers are required.

The Land Traffic Control Officers shall solve the issues immediately when accident occurred, barrier, traffic jam or special travel.

The Land Traffic Control Officer shall have the special rights than traffic signal system.

 

Article 28 (Amend) Rights and Duties of Public Road Police and Traffic Police

Public Road Police and Traffic Police shall have the rights and duties as follow:

1. To provide convenience, control, inspection of compliance with this law and relevant laws;

2. Inspection of drivers, driving license, vehicles documents, alcohol test and  over speed limits; law;

3. Training, request for a fine or further legal proceedings when commits and violating of this

4. Detaining vehicles and drivers when accident occur caused death, seriously injured  or escape for further legal proceedings;

5. Detaining vehicles that not obtained any insurance when accident occurred caused injured and parties are fails to negotiate;

6. Lock vehicles when parking at the wrong place and obstruct the land traffic;

7. Inspection of black smoke, white smoke, noise of vehicles;

8. Maintenance vehicles and materials in a good conditions when detains vehicles;

9. Recording information, follow up persons who violating of this laws and propose to the officers;

10. Inspections, record of event, take a photo and mark the place where accident occurred, clear, provided full information together with examine accessories parties and  witness in  such events;

11. Complying with rights and duties under laws.

Public Road Police shall have the rights and duties to cooperate with the officer of Public Works and Transport for inspection of land transport on public road.

 

Article 29 (Amend) Rights and Duties of the Public Works and Transport Officers  The Public Works and Transport Officers has the following rights and duties:

1. To provide convenience, control and inspection of land transport businesses operations,

investigation of vehicles technical, loading of all vehicles, drivers, officers of transport goods and passengers;

2. To coordinate with the land traffic polices, public road polices for convenience, control and tidy for transport on the way;

3. To inspect of facilities, encumbrance of traffic and way based on ordinary basis to rectify.

Article 30 (New) Authorised Persons from the State

The Authorised Persons from the State are inclusive of persons or volunteer that the State has assigned for a purpose of support, control and facilitate the land traffic from time to time.

Rights and Duties of the authorised persons are described in specified regulations.

Article 31 (Amend) Inspection and Handling of Accidents+

When an accident happens in a certain location, the traffic police or public road police shall undertake an inspection of such accident immediately, recording, taking a photo and mark with clean, clear, full details of the place accident occurred together with inspection of relevant persons and witness in that event to solve the problem under laws and also removing such vehicles out of way and any encumbrance from the paths of land traffic.

 

 

Category 5

Road Construction and Road Maintenances

Article 32 (New) Road Construction Projects

All Road Construction Projects shall pass the following traffic safety procedures:

  • Possibilities study of the projects;
  • Preliminary drawings;
  • Construction drawings;
  • Constructions Periods;
  • Commencement Period;
  • Operation Period.

Each procedure is described in a specific regulation.

 

Article 33 (New) Road Construction and Road Maintenances

Road Construction and Road Maintenances shall warranty the reducing of environment and social impact as follow:

  • Convenience land traffic, clear and tidy;
  • Safety by instalment of signal posts, glitter caution mark, instalment of traffic lights at dark

time;

  • Assist in disabled, infirmity and persons who not able to support himself;
  • Construction or maintenance shall successful, expeditious and high qualify.

 

 

Chapter III

Technical Standard and Vehicles Protection

Category 1

Vehicles Technical Standard

Article 34 (Amend) Vehicles Type

Vehicles used in Lao PDR are divided into two types namely engine type and without engine type.

Engine type included motorcycles, motor tricycles, fourwheeled vehicles upward together with all types of engine vehicles.

Without engine type included bicycles, tricycles, carts, wheeled and so on that drag, push by persons or animals.

Article 35 (Amend) Vehicles Technical Standard

All types of vehicles imported, produced, assemble to be registered and used permanently in the Lao PDR shall comply with the technical standards of production factories, qualify as pecified by the Ministry of Public Works and Transports, and follow with treaty and international treaty that Lao PDR is a member.

For all types of vehicles from fourwheeled onward shall have the steering wheels on the left hand side except transport vehicles that operate cross border transport business as specified in article 15 of the Land Traffic Law.

Article 36 (Amend) Inspection of Vehicles Technical Standard

All types of vehicles shall strictly passed the inspection of technical standard and obtain certificate with the Inspection Center as certify by the Ministry of Public Works and Transport.

Article 37 (Amend) Repair of Vehicles

It shall not obstruct the traffic, environment, safety and correctly the technical standard when repairing of vehicles as specified by the Ministry of Public Works and Transports.

Establishment of repair shop and garages are specified in regulations.

 

Category 2

Vehicles Protection

 

Article 38 (New) General Regulations

Drivers for all types of vehicles shall strictly comply with the land traffic regulations, post the license plate, having relevant documents and obtained insurances as stipulated in article 42 of this law. For Twowheeled hand tractors, twowheeled trailerpulling tractors shall have brake, front light, back light and post glint sticker at the side and back.

Drivers for all types of vehicles without engines shall strictly comply with the land traffic regulation. For bicycle, tricycle shall have brake, front light, back light and post glint sticker at the side and back.

Article 39 (Amend) Registration of Civilian Vehicles

All types of civilians vehicles, including trailer trucks, trucks and heavy machineries such as: bulldozers, excavators, motor graders, compactors, and other heavy machineries, shall register and have licence plates in accordance with the regulations issued by the Ministry of Public Works and Transport.

Vehicles that sold from the shop shall post the license plate for facilitate the inspection of relevant officers and the seller shall responsible for registration of vehicles to the customers.

Article 40 (Amend) Registration of Vehicles of National Defence and Security Forces

Vehicles that are directly used for the activities of the National Defence and Security Forces shall be registered with, and have license plates of, the Ministry of National Defence or the Ministry of Interior.

Vehicles of persons which belong to the National Defence and Security Forces shall be  registered with, and have license plates of, the Ministry of Public Works and Transport.

Article 41 (Amend) Removal of Heavy Vehicles

The removal of heavy vehicles on public road shall be done by flatbed tow trucks or other transport trucks that meet technical standards; it shall post a mark if some parts were beetle from such vehicles, caution mark under regulations and shall get approval as stipulated in article 39 of the land traffic law.

Article 42 (New) Vehicles Insurances

All vehicles shall obtain insurances as specified under Insurance Law.

 

Chapter IV

Land Traffic Businesses

Article 43 (New) Land Traffic Business Types

Land Traffic Business Types are provided as follow:

1. Technical Inspection of Vehicles;

2. Vehicles Driver Education;

3. Production, instalment, Post Maintenances, Signals, Traffic Marks;

4. Vehicles Repair Services;

5. Car Park Services;

6. Tow Vehicles Services.

Article 44 (New) Establishment of Enterprises in respect of Land Traffic Businesses

Individuals, juristic person or organizations for both domestic and outside country who aim to establishment of enterprises in respect of land traffic business will obtain an approval for operate such businesses as specified under the Enterprises Law and Investment Promotion Law included the following conditions:

  • Economic Technical Assessment;
  • Having technocrats who gain experience for facilitate businesses operations;
  • Having technocrats who gain knowledge, capacity and specific experience in respect of land traffic as appropriate;
  • Having capital, vehicles machineries and materials as appropriate;
  • Having Registered Office Certificate;
  • Having Bank Statement Certificate;
  • Having ethics profession in respect of land traffic.

Public Works and Transport Department shall investigate the above referenced conditions and consider their opinion prior the registration of enterprises.

 

 

Chapter V

Association and Foundation in respect of Land Traffic

 

Category 1

Support Safety on Road Association

 

Article 45 (New) Registered Address of the Support Safety on Road Association

Pursuant to the laws, the Support Safety on Road Association is one of social organization under the Ministry of Public Works and Transport for a purpose of coordination center on land traffic matters and all social parts in order to develop the land traffic.

Article 46 (New) Intendancy of Association

The Support Safety on Road Associations has an intendancy for contribute the unity, intelligence of technocrats, facilitate of the land traffic and all segments, movement under the constitution, laws, regulations and ethic profession in order to protect, promote and development of career parts included contributed of benefits to the social and development the country.

Article 47 (New) Rights and Duties of Association

The Associations has the following rights and duties:

1. Developing regulations, operation plans, advertisements, published policy, laws, development of national economic and social plan together with development of the land traffic;

2. Supporting, establishment, promote the member and amendment of responsibilities, profession in order to obtain any progressive and successful;

3. Protecting of rights, rightfully benefits for members based on policy and laws;

4. Requesting for using modern technical sciencetechnology in respect of the land traffic;

5. To exchange of case study, experience in respect of the land traffic in order to improve any knowledge and capacity of members;

6. To seek for funding from all segments included domestic and outside country to the land traffic;

7. Increasing of unity in association and technocrats and coordinate with other associations for both domestic and outside country as assigned.

8. To  summarize  and  report  the  performance  with  the  Ministry  of  Public  Works  and Transport and relevant departments based on regularly basis.

9. To exercise such other rights and performs such other duties as assigned by the laws.

 

Category 2

Foundation in respect of Land Traffic

Article 48 (New) Foundations

The Foundations in respect of Land Traffic is one of social organization without seeking profits, establishment and operations under laws and regulations to assist victims from road accident.

Article 49 (New) Rights and Duties of Foundations

The Foundation has the following rights and duties:

1. To assist and support victims from road accidents;

2. To attempt and obtain support in terms of technical, academic, capital, materials and vehicles from sociality included domestic and outside country;

3. To use appropriate vehicles, equipment, and technical subjects to undertake the works;

4. To coordinate with the relevant departments in respect of assist and support victims from road accident, exchange of case study, experience with foundation and related departments;

5. To  summarize  and  report  the  performance  with  the  Ministry  of  Public  Works  and Transport and relevant departments based on regularly basis.

 

Chapter VI

Prohibits

Article 50 (New) General Prohibits

Individuals, juristic person or organizations are prohibits the following acts:

1. Destroying  land  traffic  signal  such  as  signal  post,  mark,  traffic  light  included  made adulterated thing and conceal the traffic signal post;

2. Posting licenses plates not correctly under regulations;

3. Posting signs, advertisements, leave marks, sell goods, organize ceremony on the way, sideways and prohibit area without permission;

4. Playing sports on sideways and walkways;

5. Constructing, elaborate, building on the preserve way;

6. Operating businesses on curve, narrow parts or sideway may risks for accident occurs and dangerous park;

7. Excavating, cover with soil, piles soil, piles materials on the way and sideway;

8. Releasing dung, slush, sewage, oil, wash vehicles on the way and sideway;

9. Parking on walkway, crossroad, curve, narrow paths, entry  exit ways to the bridge and on the bridge;

10. Releasing children cross the way, play on sideway alone;

11. Raising, release animals on the way, move animals on the way without controller;

12. Violation land traffic regulations and relevant laws.

Article 51 (New) Prohibits for Drivers

Drivers are prohibits to do the following acts:

1. Driving vehicles when drunk;

2. Driving  vehicles  fast  and  over  speed  limit  specified,  convexity  to  the  left  and  right, careless, and violating of the laws;

3. Using cell phone, electronic devices when cross the way;

4. Using cell phone, watching TV or playing electronic devices when traveling on vehicles;

5. Operating on the wrong side of the road;

6. Driving motorcycles, all types of bicycles on endways and obstruct way;

7. Parking huge vehicles on the way and block the land traffic;

8. Raise an umbrella when travelling on motorcycles, bicycles;

9. Over loading of passengers, goods, and capacity;

10. Carry on hazards goods without permission;

11. Repair vehicles on the way, on the bridge;

12. Operating vehicles that emit noise above the standard;

13. Racing all vehicles without permission;

14. Lay log, lever, stones or any obstruction that trig vehicles on the way;

15. Violation land traffic regulations and relevant laws.

Article 52 (New) Prohibit for the land traffic operators businesses The land traffic operators shall prohibit as following:

1. To rent and assign enterprise registration certificate;

2. To sell, transfer the land traffic projects without permission of the owner;

3. To operate business incorrectly type as permission;

4. To conspire, employ, provide bribe for benefit of businesses;

5. Violation land traffic regulations and relevant laws.

Article 53 (New) Prohibit for the land traffic control officers and relevant officers

The land traffic control officers and relevant officers shall prohibit as following:

1. To operate businesses, consult or be technocrat officers with the land traffic enterprises;

2. To disclose auction information in respect of construction project, repair and instalments of the land traffic;

3. To conspire, requested, demand, received bribe, over limit for exercise power, counterfeit of documents, abuse of official functions for individual and group;

4. To neglect of duties, postpone documents in terms of the land traffic, remain inactive for incorrect act of operators;

5. To insult and bad behaviour, threaten the passer and drivers;

6. Violation land traffic regulations and relevant laws.

 

Chapter VII

Resolutions of the Difference

Article 54 (New) Resolutions of the difference types Resolutions of the difference has the following types:

The Committee shall coordinate with domestic and international for protect the land traffic to obtain progress and expand into the national defense arm force  national security arm force.

Article 61 (New) Safety on Public Road Committee Systems

The Safety on public road committee systems has the following systems:

1. National committee for safety on public road;

2. District, SubDistrict Committee for safety on public road;

3. City, municipality Committee for safety on public road.

 

Article 62 (New) Structures of National Committee for Safety on Public Road

The national committee for safety on public road has the following structures:

1. Public works and Transport Minister as a Chairman;

2. Defense Deputy Minister as a ViceChairman;

3. Education and Sports Deputy Minister as a Committee;

4. Public Health Deputy Minister as a Committee;

5. Statement, Cultures and Travel Deputy Minster as a Committee;

6. Finance Deputy Minister as a Committee;

7. Chairman of Kadaeng Lao Organization as a Committee;

8. Vice  Chairman of Lao Trade Union Center as a Committee;

9. Vice  Chairman of Lao Women Union Center as a Committee;

12. Representative of the road traffic foundation as a Committee.

The National Safety on Public Road shall appoint by the Prime Minister and the secretary department residing at the Ministry of Public Works and Transports appointed by the Chairman of National Committee for Safety on Public Road.

Article 63 (New) Provincial, Capital Committee for Safety on Public Road Structures

Committee for safety on public road in each province, capital has the following structures:

1. Head of public works and transport department as a Chairman;

2. Vice  Chairman of the national defense arm force department as a Vice  Chairman;

3. Vice  Chairman of educations and sports department as a Committee;

4. Vice  Chairman of public health department as a Committee;

5. Vice  Chairman of statement, cultures and travel department as a committee;

6. Vice  Chairman of finance department as a committee;

7. Head of Provincial, Capital Kadaeng Office as a Committee;

8. Vice  Chairman of Provincial, Capital Lao Trade Union as a Committee;

9. Vice  Chairman of Provincial, Capital Lao Women Union as a Committee;

10. Deputy  secretary general Provincial, Capital Lao Uprising People as a Committee;

11. Representative of the relevant businesses sectors included the state sector and private sector as a Committee;

4. Vice  Chairman of the public health office as a Committee;

5. Vice  Chairman of the statement, cultures and travel office as a Committee;

6. Vice  Chairman of the finance office as a Committee;

7. Vice  Chairman of kadaeng office as a Committee;

8. Vice  Chairman of Capital, Municipality Lao Trade Union as a Committee;

9. Vice  Chairman of Capital, Municipality Lao Women Union as a Committee;

10. Deputy  secretary general Lao uprising people: Capital, Municipality as a Committee;

The Capital, Municipality National Committee for safety on public road shall appoint by Provincial Governor, Head of Municipality Governor and the secretary department residing at the Ministry of Public Works and Transports appointed by the Chairman of Capital, Municipality National Committee for safety on public road.

Article 65 (New) Rights and Duties of Safety on Public Road Committee

The Safety on public road committee shall have rights and duties as follow:

1. To establishment of internal regulations, investigation policy, strategic plan and  safety operation plan;

2. To establishment of policy, strategic plan and safety operation plan;

3. To  advice,  follow  up,  inspection,  constrain  from  and  coordinate  with  other  sectors, township and relevant sectors for safety on public road;

4. To seek for foundation, protection and facilitate fund from domestic and outside country into the safety on public road;

5. To Discuss and cooperation with outside country as assigned;

6. To summarize report of the land traffic performance with the superior;

7. To comply right and other duties as assigned and specified under laws.

 

Chapter IX

Protection and Inspection of Land Traffic

Category I

Protection of the Land Traffic

Article 66 (Amend) Protection of Land Traffic Organization

The State shall protect the land traffic and apply throughout the country by assigned the Ministry of Public Works and Transport to responsible and lead included cooperate with the Ministry of defense, other Ministry, other organizations and relevant municipalities.

Protection of land traffic organization shall include:

1. Ministry of Public Works and Transport and Ministry of Defense;

2. Provincial, Capital Public Works and Transport Department and Defense Department;

5. To coordinate with the Ministry of Defense, Ministry, other relevant organizations and Municipality for issue policy, strategic plan, operation plan regarding the land traffic;

6. To manage and inspect vehicle registrations to issue the correct licenses throughout the country;

7. To study and analyse road accident statistics and the volume of traffic throughout the country;

8. To issue regulations of vehicles and license plate, vehicle registrations, production and fix licenses plates included cooperation with the provincial governor and license plate auctions, training, examination and issue driving license throughout the country;

9. Improve, maintain and exaltation personnel skill on the land traffic;

10. To cooperate with international organisations and seek funding for the development of land traffic;

3. To advertise, circulate policy, strategic plan and laws in relation to the land traffic for obtain any conscious with people;

4. To coordinate with the Ministry of Public Works and Transport, other Ministry, other relevant organization and municipality for comply with policy, strategic plan, master plan in respect of the land traffic;

5. To Lead, follow, facilitate and control the land traffic on the way;

6. To inspect the vehicles information to for the production of licenses plates;

7. To protect vehicles registration, production responsible, fix and use licenses plates;

8. To protect safety and allocate the land traffic to be in order, ascertain road  accident statistics and the volume of traffic for protect plan and reduce the road accident;

9. To follow and evaluate the compliance under the land traffic law and relevant laws throughout the country;

10. To protect and upgrade the land traffic police, public road police included centralize and municipality together with provide necessary materials and vehicles to undertake the performance;

2. To coordinate with the defense headquarter, other departments for train, advertise, circulate to obtain the civil social in respect of land traffic within province, capital;

3. To  ascertain  road  accident  statistics  and  the  volume  of  vehicles  and  traffic  within province, capital;

4. To protect vehicles registration, safety on land traffic and driving, driving school, driving center, driving examination, technical inspection, vehicle garages and other businesses related to land traffic;

5. To insert vehicles data for issuance of license;

6. To propose proposal for capital in domestic and outside country to development of land traffic within province, capital;

7. To protect, install the post and land traffic mark, follow, conservation of post, land traffic marks on the way to avoid any destruct;

8. To  arrange  examination,  issuance  of  driving  licenses,  vehicles  registration,  fixes  the vehicles license plates within province, capital;

9. To summarize and report the land traffic performance with the Ministry of Public Works and Transports, Provincial Governor, Capital Governor based on regularly basis;

10. To exercise such other rights and performs such other duties as assigned by the laws.

In the management of land traffic, the Defense Headquarter at each province, capital has the following main rights and duties:

1. To establishment of the policy, strategic plans and master plan on the land traffic within each province, capital;

2. To coordinate with the Public Works and Transport Department, other departments for train, advertise, circulate to obtain the civil social in each province, capital;

3. To strictly follow any respect and comply with the laws for drivers and vehicles on the land traffic road to protect safety and tidy of the land traffic;

4. To inspection of vehicles information prior production or fix the license plates;

5. To product and fix the license plates as assigned by the Ministry of defense;

6. To investigate, ascertain road accident statistics and the volume of vehicles and traffic within Province, Capital for reduce and intersection of accidents;

7. To ascertain, solve the road accident cases under laws within each province, capital;

8. To protect and lead traffic police, public road within capital, municipality;

9. To summarize and report the land traffic performance with the Ministry of Defense, Provincial Governor, Capital Governor based on regularly basis;

Article 71 (Amend) Rights and Duties of Capital, Municipality Public Works and Transport Office

In the management of land traffic, the Public works and Transport Office in each capital and municipality has the main following rights and duties:

1. To establishment of the policy, strategic plans and master plan in respect of land traffic under responsibilities;

2. To coordinate with the Defense Headquarter, other offices for train, advertise, circulate to obtain the civil social in relation to land traffic in each capital, municipality;

3. To establishment, protection of vehicle registration, driving licenses examination for motorcycle, Twowheeled hand tractors, twowheeled trailerpulling tractors within capital, municipality;

9. To summarize and report the land traffic performance with the provincial, capital, and municipality Public Works and Transport Office based on regularly basis;

10. To exercise such other rights and performs such other duties as assigned by the laws.

Article 72 (Amend) Rights and Duties of Capital, Municipality Defense Headquarter:

In the management of land traffic, the Defense Headquarter in each capital, municipality has the following main rights and duties:

1. To establishment of the policy, strategic plans and master plan in respect of land traffic under responsibilities;

2. To coordinate with the Public Works and Transport Office, other offices for train, advertise, published for a purpose of obtain the civil social in relation to land traffic within capital, municipality;

3. To coordinate with the Public Works and Transport for protection of land traffic posts, land traffic marks on the land traffic way in each capital, municipality;

4. To tidy allocate on the land traffic way, public vehicles parks and facilitate any convenience, land traffic control for aerate, safety and convenience;

5. To investigate, examine, solve and brief road accident occur in each capital, municipality according to the laws;

6. To ascertain road accident statistics and the volume of vehicles and traffic within capital,municipality;

7. To summarize and report the land traffic performance with the Defense Headquarter Province, Capital, Capital Polity, and municipality based on regularly basis;

8. To exercise such other rights and performs such other duties as assigned by the state.

Article 73 (New) Rights and Duties of Villages Polity

In the management of land traffic, the Villages Polity has the following main rights and duties:

1. To circulate order, memorandum, instruction in relation to land traffic to the people in villages;

2. To excite people for protect the signal signs, signal lights, land traffic marks on the way together with report the damages of posts, traffic lights, land traffic marks to the Public Works and Transport Capital, Municipality immediately;

3. To participate, assist to control place of accident occurred and report to the traffic police, public police Capital, Municipality immediately;

4. To facilitate any convenience and participate with the land traffic control officer;

5. To exercise such other rights and performs such other duties as assigned by the laws.

 

 

Category 2

Inspection of Land Traffic

 

Article 74 (New) Inspection Organizations

Inspection Organizations shall divided into two types as follow:

1. Internal Inspection Organization shall mean the same organization as protection of land traffic organization as stipulated in article 66 of this law;

2. External Inspection Organization shall include:

  • National Assemble as specified under the law on inspection of National Assemble;
  • State Inspection and Anti _ Corruption Organization as defined under the law on Anti Corruption;
  • Investigation Organization as described under the law on State Investigation;
  • Lao National Building, Public Organizations, People, and Media.

External Inspection is aim to inspect, discharge of protection, and inspection land traffic organization for a purpose of quality, fair, reveal, and strong.

Article 75 (New) Rights and Duties of Inspection Organizations

The Inspection Organizations shall have the rights and duties as stipulated in articles 76 and 77 of this law.

Article 76 (New) Details of Inspection

Details of inspection for land traffic are provided as follow:

1. Establishment of the policy, strategic plans, master plan, laws in respect of land traffic;

2. Construct Projects, instalments, repairs and maintenances for land traffic signal system;

3. Comply land traffic safety measure, resolving of life impact, health, people assets, public assets and environment;

4. Business Operations for repairs, modify, vehicles technical inspection, training, test and driving licenses examinations;

5. Operators documents, documents and vehicles licenses plates, alcohol test and speed limit of all vehicles which assigned land traffic police and public road police to inspect such documents.

It is required to comply with any provisions for inspection as specified under other relevant laws.

Article 77 (New) Inspections Types

Inspection of Land Traffic shall divide into three types as follow:

1. Ordinary Inspection shall inspect as plan based on regularly basis and defined in a specific timeframe;

2. Advance Notice Inspection shall inspect as necessary needed by provided advance notice;

3. Unexpected Inspection shall inspect immediately without notice.

It is required to strictly comply with the laws for inspection of land traffic.

 

Chapter X

National Weeks for Safety on Land Traffic Uniforms and Marks

Article 78 (New) National Weeks for Safety on Land Traffic

The National weeks for safety on land traffic are defined as the first week of April.

For each year, Ministry of Public Works and Transports shall be a host and cooperate with the Ministry of Defense, other Ministry, other organizations and all local authorities for plan, ask for assistances, vehicles, materials support and capital with all social sectors for the broad operation of safety on land traffic in that week.

Article 79 (New) Uniforms and Marks

The Ministry of Defense shall define uniforms, marks for the land traffic police and public road police.

The Ministry of Public Works and Transports shall define uniforms, marks for the the Public Works and Transport officer

 

Chapter XI

Policies Towards Persons with Outstanding Achievement and Measures Against Violators

Article 80 Policies Towards Persons with Outstanding Achievement

Individuals, Juristic Persons or organisations that participate in the management of land traffic effectively and that ensure safety and orderliness, or preserve and protect cleanliness, the environment, the traffic signal system, or the property of the State and individuals along the roads will be rewarded and receive other policies, as appropriate, that will be determined in detail by the government.

Article 81 Measures Against Violators

Individuals, Juristic Person or organizations that violate any provision of this law and other relevant laws will be reeducated, fined, compensate damages or subject to laws sanctions, depending on the severity of the case.

Article 82 ReEducation Measures

Individuals, Juristic Person or organizations that commit a minor violation of any violation of this law and relevant laws and not subject to criminal sanctions, will be reeducated and cautions.

Article 83 Discipline measures

The Land Traffic Control Officer and relevant officers who violating of this law and relevant laws and not subject to criminal sanctions, less damages and not pay attention to report the offence, evasion of commit, shall subject to discipline sanctions such as warn, cancel of promote and dismiss.

Article 84 (Amend) Fines

Individuals, Juristic Person or organizations that violate any provision of this law and relevant laws and not subject to the criminal sanctions shall compensate for a fine in the following cases:

  • Driving vehicles when drunk and over limit specified;
  • Driving vehicles fast and over speed limit specified;
  • Not wearing standard helmets when travelling on motorcycles;
  • Raise an umbrella when travelling on motorcycles;
  • Using cell phone, watching TV or playing electronic devices when traveling on vehicles;
  • Disobeying traffic lights, signs, and marks;
  • Not having driving licence or the documents accompanies vehicles;
  • Operating on the wrong side of the road;
  • Operating vehicles that emit noise above the standard;
  • Turning on the high beam headlight in violation of regulations;
  • Not turning on lights in the evening;
  • Turning on the light(s) on only one side for fourwheeled vehicles on ward;
  • Not turning on lights during the daytime when the weather causes poor visibility, such as: heavy rain, thick fog, dusts;
  • Emission of smoke beyond the standard;
  • Having a vehicle without brakes, having no rear view mirror;
  • Causing dirt and obstacles on the roads;
  • Over loading, over size, over limit;
  • Modify vehicles technical without permission;
  • Violation land traffic regulations and relevant laws;

Fine rates are defined in accordance with specific regulations.

Article 85 (New) Commercial Measures

Any  individual,  Juristic  Person  or  Organizations  who  commits  and  offence  in  terms  of commercial and violating this laws shall subject to the compensate such damage occur.

Article 86 Criminal Measures

Any individual who commits an offence in terms of criminal and violating this law shall

subject to the criminal sanctions.

Article 87 (New) Supplementary Measures

In addition to the main measures provided for in article 86 of this law, offenders shall be liable to supplementary measures such as loss point of driving licenses or removal of licences under specific regulation.

 

Chapter XII

Final Provisions

 

Article 88 Implementation

The government of the Lao People ' s Democratic Republic is assigned to implement this law.

Article 89 Effectiveness

This law shall come into effect after sixty days from the date of the promulgating decree issued by the President of the Lao People's Democratic Republic.

This law shall supersede the previous land traffic law no. 02/NA, dated 08 April 2000. Provisions and regulations that contradict this law are null and void.
