Decision
Concerning fees, service charge in seeking authority to operate business and fees
For yearly management of Financial Institution
According to the law on the bank of Lao PDR No. 05/NA, dated issue 14 October 1999;
According to the Decree on the Micro Finance Institution No. 460/GO, dated 3 October 2012;
According to the Decree on Leasing Business No.11/PM, dated 15 February 1999;
According to the Decree on Pawn-shop No.10/PM, dated 2 February 2002;
The Governor of the Bank of the Lao PDR agree that:
This Decision determines fee for submitting document applying for business operation license, service charge for consideration in issuing business operation license and fee for annual management of Financial institution seeking authorization to operate business in the Lao PDR, to be used as reference for the uniformity in the implementation throughout the Financial Institution system.
Article 2 Fee for Submission of Document Applying for Business Operation License
The person who seeks authorization to operate business have to pay fees for document submission in seeking permission to operate business and to expand branch or service unit to the Bank of the Lao PDR as follow:
Micro-Finance Institution which accepts deposit from Head Office in the amount of 3.000.000 Kip;
Micro-Finance Institution which accepts deposit from Branch Office in the amount of 1.000.000 Kip;
Micro-Finance Institution which doesn’t accept deposit from Head Office in the amount of 500.000 Kip;
Credit Co-operative and saving account in the amount of 100.000 Kip
Leasing Company’s Head Office in the amount of 5.000.000 Kip
Leasing Company or service unit in the amount of 1.000.000 Kip
Pawn-shop’s Head Office in the amount of 500.000 Kip
Micro-Finance Project in the amount of
200.000 Kip
Article 3 Service Charge for Consideration in Issuing Business Operation
The person who seeks permission to operate business have to pay for service charge to the Bank of Lao PDR for consideration in issuing business operation license after obtaining a permission to temporarily operate business which has detail as follow:
Micro-Finance Institution which accept deposit with a register capital of 3 billion kip must pay in the amount of 30.000.000 Kip
The branch of the Micro-Finance Institution with a registered capital of Billion Kip must pay in the amount of 10.000.000 Kip
Micro-Finance Institution which doesn’t accept deposit with a registered capital of 200 million Kip must pay in the amount of 2.000.000 Kip
Credit Co-operativesaving account having a registered capital of 100 million Kip must pay in the amount of 1.000.000 Kip
Leasing company with a registered capital of 5 billion Kip must pay in the amount of 50.000.000 Kip
The branch of leasing company with a registered capital of 1 billion Kip must pay the amount of 10.000.000 Kip
Pawn-shop with a registered capital of 500 million Kip must pay in the amount of 5.000.000 Kip;
Micro-finance Project must pay in the amount of 2.000.000 Kip
Calculation of service charges for consideration in issuing business operation license shall equal to 1% of each form of registered capital.
Article 4Fee for Yearly Management
Micro-Finance Institution which accept deposit, Micro-Finance Institution which doesn’t accept deposit, leasing company, pawn-shop, including branch of such institutions, credit co-operative and saving account and micro-finance project have to pay fees for yearly management to the Bank of the Lao PDR amounted 0,05% of the average value of property or at least 0,5% of the registered capital..
Article 5 Payment of fees for document submission, fees of consideration in issuing business operation license and and fees for yearly management
The person who seeks permission to operate financial institution business have to pay the fees for document submission when submitting an application to the Bank of the Lao PDR and such submission fees shall be unrevokable. Besides that the fees of consideration in issuing business operation license shall be paid on day of obtaining a temporary business operation license;
Financial Institution have to pay fees for yearly management before 31 January of the following accounting year.
The Financial Institution Supervision Department, Operation Department, branches of the Bank of the Lao PDR and other Financial Institution are assigned to strictly implement this Decision.
The Decision shall be Effective from the date of signature.
