DECISION
of the Minister on
Management of Truck Weight Measurement Countrywide
- Pursuant to the Decree of the Prime Minister No.: 373/PM, dated 22 October 2007 on the Organization and Operation of the Ministry of Public Works and Transport;
- Pursuant to the Resolution of the Government of the Lao PDR on the outcome of the meeting between the government and governors of Vientiane Capital and other provinces countrywide No. 01/G, dated 9 February 2011;
- Pursuant to the Notice of the Secretariat of the Government No.: 1179/SG, dated 17 June 2011 on the dissolution of checkpoints with improper fee collection and the facilitation of trucks and transport vehicles to cross international border checkpoints countrywide.
The Minister of Public Works and Transport hereby issues a Decision:
Article 1: To maintain 13 weigh stations located at each international border checkpoint to measure the weight of trucks on a regular basis.
Article 2: To maintain 24 weigh stations (the locations of these stations are stipulated in an attached document) which are referred to as ad hoc weigh stations located along highways for specific vehicular weight inspection. Officers working at these stations have a duty to inspect trucks on an occasional basis and based only upon particular cases or circumstances.
Article 3:The determination of duties in the management of weigh stations:
- All weigh stations as mentioned in Articles 1 and 2 above located in any locality shall be supervised by a provincial or capital Division of Public Works and Transport of that locality. The 24 ad hoc weigh stations must have their officers, who are civil servants, working at the stations on a 24-hour basis in order to protect the assets of the stations and to be ready to perform their duties, and those officers shall be entitled to salaries and incentives in accordance with laws and regulations.
- An ad hoc inspection shall be permitted by a provincial governor at provincial level and the Minister of Public Works and Transport at central level.
- For the weight inspection, if the weight of a truck exceeds the limit, the overweight goods must be discharged and the truck driver or owner shall be subject to measures in accordance with laws and regulations. Besides the weight measurement or inspection in accordance with regulations, truck drivers are prohibited from stopping their trucks or discharging goods in the station area in order to avoid damage being caused to the area or other assets of the stations.
Article 4:If it is necessary to construct a new ad hoc weigh station with the aim of protecting main roads, the provincial and capital Division of Public Works and Transport is assigned to review and consider its construction, and thereafter propose it to the Minister of Public Works and Transport through approval from the provincial or Vientiane Capital governors.
Article 5:The Transport Department or a provincial or capital Division of Public Works and Transport are assigned to disseminate this Decision and monitor the implementation of weight inspection effectively.
Article 6: This Decision is effective from the date of signature.
