REGULATION

on

Vessel Construction License

  • Pursuant to the Prime Minister’s Decree, No.: 07/PM, dated 29 January 1993 on the Organization of the Ministry of Communication, Transport, Post and Construction;
  • Pursuant to the Direction on the Development of Waterway Transport of the Government until the year 2000;
  • Pursuant to previous period that local vessel construction companies were noncompliant with laws and regulations.

‘Vessel’ refers to a motor or manpowered vehicle that operates on water, which is constructed for transporting goods, passengers, tourism, fishery, dredging, and others.

To be one of the factors for waterway transport development, and to facilitate vessel construction to be compliant with regulations, and to be properly managed, the Ministry of Communication, Transport, Post and Construction hereby issues this regulation on Vessel Construction License as following:

 

  1. A person who wishes to build a shipyard or a dockyard shall obtain a license and an enterprise registration certificate by complying with the Regulation on the Issuance of Operating Licenses for Manufacturing-Transport Business, Construction and Repair of Transport Vehicles, No.: 494/MCTPC, dated 19 March 1990.
  2. Construction of vessels by individual or other sectors requires designs and inspection from any vessel-designing institutes for certification consisting of:
  3. Construction of transport vessels including large ferries with a capacity of 20 tons or over;
  4. Construction of passenger vessels with a capacity of 10 people (10 seats) or over.
  5. The construction of goods transport vessels with a capacity of less than 20 tons and passenger vessels less than 10 people (10 seats) can be approved without being certified in terms of design by a vessel-designing institute.
  6. Vessel construction as defined in Clause 2 and 3 above shall be approved by the Ministry of Communication, Transport, Post and Construction.
  7. The construction of vessels as local transport vehicles, such as boats, rowboats, or motor boats can be carried out provided those vessels are registered with a village office prior usage.
  8. All types and sizes of vessels mentioned in Clauses 2 and 3 above, upon completion of construction, shall be registered with Division of Communication, Transport, Post and Construction in provinces, Vientiane Capital, and special zones in accordance with regulations.
  9. Vessel construction business operators shall comply with obligations to the government in accordance with regulations.
  10. The Division of Communication, Transport, Post and Construction in provinces, Vientiane Capital, and special zones is assigned to cooperate with relevant officers to implement the inspection of vessel construction in accordance with this Regulation.
  11. This Regulation is effective after 30 days from the date of signature.
