NOTIFICATION
ATTN:
- Provincial and Capital Industry and Commerce Divisions;
- District and Municipal Industry Offices;
- Domestic and Foreign Business Persons;
RE: List of Reserved Businesses for Lao Citizens (Amended / C 02-2015).
- Pursuant to Article 13 of Decision No. 1005/MOIC.ERM, dated 22 May 2015 On Wholesale and Retail Businesses;
- Pursuant to Item 1 (contents) of the Notification No. 0515/MOIC/DTD, of the Domestic Trade Division, dated 17 June 2015; and
- Pursuant to Proposal Letter of the Office of the Bank of the Lao PDR, No. 685/OBOL, dated 16/10/2013 on the Addition of Pawn Brokers to the List of Reserved Businesses for Lao Citizens.
In order to reserve vital and necessary categories of businesses for the Lao public, ethnic minorities in the operation of business, creation of jobs, generation of stable income, and improvement living standards, the Ministry of Industry and Commerce (on the basis of the study of proposals from the relevant sectors), of certain business categories (in List C 01-2013) into (List C 02-2015), hereby notifies the relevant of authorities for acknowledgement and implementation as follows:
- Reserved categories of businesses for Lao citizens are business categories with a long heritage of the public and ethnic minorities, [being] business categories that do not require a high degree of knowledge or large amounts of capital in the operation of business or certain business which the State wishes to reserve for Lao citizens in order to reserve vital, necessary businesses or businesses that are a national identity to remain with the Lao people, create jobs, generate income and improve the livelihood of the Lao people, ethnic minorities. Lao citizens means individuals as determined in the Law on Nationality;
- The list of businesses reserved for Lao citizens (List C 02-2015attached hereto);
- The authorization or registration of enterprises for individuals or legal entities that are invalid pursuant to this Notification are hereby void, violators shall be responsible before the law;
- Relevant authorities or sectors shall have detailed and clear legislation on each item of reserved businesses for Lao citizens in order to facilitate implementation.
- During the period of implementation of this Notification, if the authorities or sectors deem that there are any inconsistences, wish to add to or remove items from the list should notify the Ministry of Industry and Commerce for future amendment and promulgation; and
- This Notification replaces Notification No. 1590/MOIC.ERM, dated 26 August 2013 On the List of Reserved Businesses for Lao Citizens.
